Welcome to thatsundaycircle.com (the "Site"), operated by That Sunday Circle ("we," "us," "our"). By accessing or using the Site, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who can use the Site
You must be at least 16 years old, and capable of entering a binding agreement, to use the Site. If you use it on behalf of an organization, you confirm you have authority to accept these terms for that organization.
2. Using the Site
You agree to use the Site lawfully and respectfully. You will not:
- Break any applicable law or infringe anyone's rights.
- Harass, threaten, defame, or discriminate against others.
- Upload malware or attempt to disrupt, probe, or gain unauthorized access to the Site or its systems.
- Scrape, copy, or harvest content or personal information by automated means without our written permission.
- Send spam or use the Site to promote unrelated products or services.
- Impersonate any person or misrepresent your affiliation with anyone.
3. Accounts, sign-ups, and events
If you register for our mailing list, an event, or a gathering, you agree to provide accurate information and to keep it up to date. Event details, schedules, locations, and availability may change, and we may cancel or reschedule an event at our discretion. If a fee applies, the price and refund terms will be shown when you sign up. Unless stated otherwise at that time, fees are non-refundable except where the law requires.
4. Our content and intellectual property
The Site, including its text, graphics, logos, design, and other materials, is owned by us or our licensors and is protected by copyright, trademark, and other laws. We give you a limited, non-exclusive, non-transferable, revocable license to view and use the Site for your personal, non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from our content without our prior written permission.
5. Content you submit
You keep ownership of anything you send us, such as comments, messages, photos, or other submissions. By submitting content, you give us a worldwide, royalty-free, non-exclusive license to use, reproduce, display, and adapt it as needed to operate, promote, and improve the Site and our gatherings. You confirm that you have the right to submit the content and that it does not violate the law or anyone else's rights. We may remove any content at our discretion.
6. Third-party links and services
The Site may link to or integrate services run by others. We do not control and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
7. Disclaimers
The Site and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error-free, or secure. Content on the Site is for general information and is not professional advice.
8. Limitation of liability
To the fullest extent allowed by law, That Sunday Circle and its owners, organizers, volunteers, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Site or attendance at any event. Our total liability for any claim relating to the Site will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100. Nothing in these terms limits liability that cannot be limited by law.
9. Indemnity
You agree to defend and indemnify us against claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, your violation of these terms, or your violation of another person's rights.
10. Suspension and termination
We may suspend or end your access to the Site at any time, with or without notice, if we believe you have violated these terms or pose a risk to the Site or others. Sections that by their nature should survive termination, including those on intellectual property, disclaimers, liability, and indemnity, will continue to apply.
11. Governing law and disputes
These terms are governed by the laws of Sri Lanka, without regard to conflict-of-law rules. Any dispute will be brought in the courts of Colombo, Sri Lanka, and you consent to their jurisdiction. Before starting a formal proceeding, both sides agree to try to resolve the matter informally by contacting each other in good faith.
12. Changes to these terms
We may update these terms from time to time. The effective date above shows when they were last revised. Your continued use of the Site after changes take effect means you accept the updated terms.
13. General
These terms and our Privacy Policy are the entire agreement between you and us regarding the Site. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign ours in connection with a reorganization or sale.
